The Importance of a Confidentiality Statement

Often in tender submissions, bidders have the option of submitting a confidentiality statement. You need to protect your business secrets and intellectual property. In any event, you need to ensure the buyer does not release your bid response or part of it due to a request under the Freedom of Information Act. It is therefore prudent that any bid includes a confidentiality statement. A good example of a statement to use is included below. This is printed in the publication titled ‘Public Procurement Rules of the Road: Navigating Public Tendering in Ireland & Northern Ireland - A €90 Billion Market’, by Peter Brennan, Joanne Gillen.

This document is provided for the exclusive use of [Contracting Authority Name] and may not be disclosed to any third party without the prior consent in writing of [Company Name]. This entire document is commercially sensitive as it is a competitive tender by a private entity. It would not be provided in the absence of this restriction on disclosure and requirement of confidentiality.
